1. Operator

This Service is owned and operated by Sonic Healthcare Limited ABN 24 004 196 909 for use by qualified medical practitioners and their nominated users. If you require any further information please contact us.

2. Definitions

Authorised User means a registered medical practitioner or their Nominated User (as defined below). Diagnostic Records means all patient test results and related data and information made available on this Service to Authorised Users who have requested the provision of Diagnostic Services and includes but is not limited to histology. Diagnostic Services means pathology and other medical investigations provided by Sonic Healthcare Limited.

Sonic Healthcare, we, us or our means Sonic Healthcare Limited ABN 24 004 196 909. Nominated User means another registered medical practitioner, or a qualified health professional in your employment who is nominated by you and approved and registered by us to access and use the Service. Password means your alpha-numeric code to be used in conjunction with your Username for access to the Service. Personal Information means Personal Information, meaning given to this term under the Privacy Act 1988 (Cth) Privacy Laws means the Privacy Act 1988 as amended and any other privacy laws or privacy codes or guidelines with which you are required to comply including those governing the practice of medicine, practitioner/patient relationships or patient confidentiality. Service means the Online Audit tool Surgical Audit portal via which you reached this page, and includes all Service Content and the Diagnostic Records available on or provided via the Service. Service Content means the compilation of the pages and on-line images of the Service including without limitation all text, graphics, icons and software, including navigational software. Username means the code we give you upon your successful registration to use the Service. You or your means you as the Authorised User and/or your Nominated User.

3. Amendments to these Conditions of Use

We may review, change or vary these Conditions of Use at any time by posting the amended Conditions of Use directly on this Service. The amended Conditions of Use will be effective immediately unless otherwise stated. Continued use of the Service by you or your Nominated User constitutes acceptance of the Conditions of Use as amended. It is your responsibility to periodically review the current Terms and Conditions posted on the Service and, if necessary, inform your nominated User of any changes.

4. Registration Process

You or your Nominated User are not authorised to access or use this Service until you have successfully completed the Registration Process and have been approved by us as an Authorised User and given a Username and Password. Sonic Healthcare Limited reserves the right to refuse to register any person as an Authorised User of the Service. Any personal information you provide to us will be handled in accordance with the Privacy Act 1988.

5. Access Audit

Users accessing patient records may have their access recorded in an audit trail. Audit trail information may be used by the laboratory to ensure patient care and confidentiality. The audit trail may be disclosed to third parties as required by law, to the requesting doctor or patient.

6. Security of your Username and Password

The Username and the Password you are given, or nominate, upon registration and use each time you access the Service enable access to sensitive and confidential information. You acknowledge that you will ensure your Username and Password are kept secure and are not disclosed to anyone except to us in accordance with these Conditions of Use.

To protect your Password you should:

  • try to memorise it and not leave it in anywhere in writing where it may be copied or used by others;
  • periodically change your Password and ensure that your Nominated User (if applicable) also periodically changes their Password.

If your Username or Password are lost or stolen, or disclosed to any other unauthorised person, or you suspect there is a risk of disclosure to others, you will:

  • immediately notify us of the circumstances; and
  • take immediate steps to change your Password.

We are entitled to rely on any communication we receive using your Username and/or Password.

Our failure to exercise or enforce any of our rights under these Conditions of Use shall not constitute a waiver of those rights unless such waiver is granted in writing.
